Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The residence can continue to be used as a residence. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />This lot is adjacent to a county road and narrows. The landowner did not create these <br />circumstances. <br />3. The variances, if granted, will not alter the essential character of the locality. <br />4. <br />5. <br />6. <br />7. <br />The variance for hardcover will not change the character of the area. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining pror«-rty. <br />The subject property has unique circumstances because of the channel, highway ’ and access. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />Most of the lots in this zoning district do not have structures that encroach into the 0-75' <br />setback as this lot. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The applicant is seeking relief from the traffic and noise next to the channel. <br />H 2373 Steven Beck <br />2793 Shadyvnod Rd. <br />Slay 18. 1998 <br />page —I
