ORDINANCE NO.SECOND SERIES <br />/A <br />AN ORDINANCE AMENDING <br />THE CITY OF ORONO ZONING CODE <br />SECTION 10.55, SUBDIVISION 15(A) <br />REGARDING USE OF WETLANDS <br />FOR DEVELOPMENT DENSITY CREDIT <br />The City Council of the City of Orono ordains: <br />Section 1. Municipal Zoning Code Section 10.55, Subdivision 15, is hereby amended as follows: <br />A. Minimum Lot Area Requirements. The minimum lot area requirements of this <br />Chapter shall be interpreted to mean that all of the required land area for each building site <br />shall be in one contiguous parcel undivided by Floodway or Flood Fringe and no land within <br />the protected area shall be included in determination of minimum lot area, except as <br />specifically provided for herein: <br />I. For properties not ser\ ed by municipal sanitary sew’er, the minimum lot <br />area may be divided by Flood Fringe lands provided at least 2.0 acres of land not <br />within the protected area is included in one contiguous parcel and legal access is <br />available to that building site without encroachment on the protected area. <br />2. For properties serv'ed by municipal sanitary sewer, the minimum lot area <br />may be divided by Flood Fringe lands provided at least one half acre of land not <br />within the protected area is included in one contiguous parcel and both municipal <br />sewer and legal access is available to that building site without encroachment on the <br />protected area. <br />—For residential properties served by municipal-sanitary scwcf a limited <br />density credit may be allowcd -for-mclusion of Flood Fringe lands as part of the <br />required minimum lot area for purposes of complying with the-land-usc dcnsit>', open <br />space, building unit to land-area ratios or other similar requirements of the-land <br />development and zoning-provisions.- The owner or devclopcr-ofsuch propcrty will <br />be credited with an amount of-his land -within the Flood Fringe equal-to, but not <br />exceeding, the amount of his adjacent land whidvotherwise-quQltficd-for development <br />under this Chapter.
