He was informed that the structure <br />could not be placed over the utility easement. <br />Berg asked what the hardship is for the proposal. Hanley said the applicant is allowed to <br />have more structure and there is no other location for its olacement. <br />Mabusth noted that the neighboring property received a variance for a tennis court. <br />There were no public comments. <br />Smith supported staff recommendation with the structure meeting the 10' side setback. <br />Mabusth moved, Stoddard seconded, to approve Application #2343 per Staff <br />recommendation. Vote: Ayes 3, Nays 1, Berg, who indicated the structure was too large. <br />(#7) #2344 DOUGLAS AND MARILYN HOLCOMBE, 1056 LOMA LINDA <br />AVENUE - VARIANCES - 9:50-9:58 P.M. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />The Applicants were present. <br />Bressler distributed photographs of the property. The proposal is to rebuild a main level <br />deck with an enclosed porch underneath with a stairway from the main level deck leading <br />down to a small deck and steps on the lake side of the porch. The proposal requires <br />variances for hardcover in the 0-75' and 75-250' lakeshore setbacks, average lakeshore <br />setback, lakeshore setback, and structural coverage. The existing deck nearest the <br />lakeshore was built without a building permit bv a prior owner. Granting the variances <br />would not result in further encroachments from existing structures. <br />Bressler reviewed the issues. The lot does not meet the lot area and width. A lot line <br />rearrangement was approved in January, 1998. The stairs and deck are the only increase <br />in structure to the house beyond what was approved with variances in in 1977. Holcombe <br />indicated that the stairs were part of the original approval. The proposal negligibly <br />increases structural coverage and hardcover as it will be primarily placed over existing <br />hardcover. <br />Bressler recommended approval for replacement of the existing deck and adding <br />stairways, enclosing the area under the deck, a second level deck, and a landing on the <br />lake side of the porch. Staff recommended removal of the lower level deck that was built <br />illegally. The applicant has agreed to this removal.
