File #2340 <br />March 13, 1998 <br />Page 5 <br />3.The Orono Trail System Plan includes a corridor along North Shore Drive. The Park <br />Commission reviewed this plat on February 2 and recommended a cash dedication, noting <br />that it appears sufficient right-of-way exists for any future trails along the County Road. <br />Riparian Access Issue <br />(See discussion in the February 12 memo) Only the lakeshore lot will have legal riparian access <br />under City ordinances. <br />Stormwater Ponding <br />The preliminaiy drainage and grading plan was received late on March 12 and has yet to be reviewed <br />by the City engineer. <br />The City normally excludes the area of required stormwater ponding from the area calculation of <br />individual lots, per Subdivision Code Section 11.41, Subdivision B (4). When the 35 ’ x 55' pond <br />is excluded, the area of Lot 1 is very slightly under 0.75 acre. The City normally excludes <br />stormwater ponds from calculable lot acreage. However, the City did allow wetland acreage to be <br />used for the ’extra 50%’ acreage requirement for unsewered back lots in the Old Crystal Bay Road <br />Addition. Does Planning Commission feel that the goals of the back lot ordinance are met by <br />crediting storm pond acreage toward the e.xcess 50% area? <br />Issues for Discussion <br />1. <br />2. <br />3. <br />4. <br />Does Planning Commission support the concept that the lot line abutting the private road <br />outlot, Outlot A, can be the front lot line, thereby making Lot 2 a conforming duplex lot? If <br />not, will Planning Commission grant a lot width variance for the duplex lot? <br />Will Planning Commission in favor of establishing a policy that stormwater ponding can be <br />credited toward the 'extra 50% area’ required for a back lot? <br />Does Planning Commission concur that applicant should be responsible for constructing a <br />24' paved road the entire length of Outlot A, and granting easements over such road to all <br />property owners that will make use of it? Does Planning Commission agree that this should <br />be a private road, and not public? <br />Will Planning Commission recommend approval of the width and length variances <br />associated with Outlets A and B?
