STATEMENT OF HARDSHIP <br />Refer to the applicants statement of hardship (Attachment K). <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property is dilapidated in its current state and remodeling is taking place. As part of <br />this remodeling, the applicants wish to replace and enclose decks primarily in the <br />same footprint as approved by a previous variance. These replacements cannot take place <br />without the granting of variances. <br />« <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The existing residence was built prior to current zoning district requirements. While the <br />portion of the lower level deck nearest the lakeshore was added by a previous owner <br />illegally, the majority of the replacements being proposed are within previously approved <br />footprint areas. <br />3. The variances, if granted, will not alter the essential character of the locality. <br />The variances for hardcover, average lakeshore setback and lakeshore setback will not <br />alter the character of the area. <br />4.The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />The porch and decks are permitted in this zoning district. <br />M2344 C.
