7. <br />8. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The property currently has an attached two-car garage. A garage of similar size could be <br />built elsewhere on the lot. The approximate proposed location appears to be the most viable, <br />however. <br />The granting of such variances will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />Due to the configuration of the subject property and location of the existing residence, <br />constructing an accessory structure in a viable location on the property without variances <br />is difficidt. <br />Issues <br />5. <br />The property meets all zoning requirements except lot width. <br />The lot configuration and location of the residence on the subject property makes <br />constructing an accessory structure that does not require variances difficult. <br />The garage doors will not be visible from the street and will face the residence instead. <br />The applicant is proposing the garage be located 5' from the east side lot line. There is <br />a 10 drainage easement along this lot line and granting the side yard variance would result <br />in encroachment into this easement. <br />The dormer over the garage will not be used for additional living space. The garage will not <br />have plumbing or heating. <br />STAFF RECOMMENDATION <br />Staff recommends approval of this application to allow the construction of a 736 s.f. garage with a <br />dormer with the condition the 10' side yard setback be met. <br />Staff recommends approval of a variance allowing fhe accessory structure to be located 227' <br />from the front lot line where the principal structure is located 329' from the front lot line and <br />no accessory structure is allowed to be nearer the front lot line than the principal structure. <br />Staff recommends denial of a side setback variance of 5' to allow the accessory structure to <br />be located 5 from the side lot line where 10' is required for accessory structures. <br />Tim and Bonnie Johnson <br />627 Ferndale Road North <br />Variances <br />March 16, 1998 <br />Page 4
