Box 66 <br />Crystal Bay, MN 55323 <br />re: 4196 North Shore Drive; conforming the tax record to reflect the legal records. <br />Dear Mike; <br />As you suggested, we are writing to provide historical data regarding a lot that was <br />attached to ours on the tax records, but never legally a part of the property we now <br />own. The following is what is reflected in the deeds of record since 1923, and <br />the recorded documents. <br />This property has been in our family since acquisition by our Great Uncle and Aunt. <br />Lot 55 was purchased by them in 1923, lots 56-61 were purchased in 1946. The deeds <br />of record have always shown only lot 55 with the house (see attached). <br />In 1986, we purchased the house. We purchased lot 55 and 56 with the house, since <br />the house encroaches upon lot 56 (see attached deed, which is recorded with Hennepin <br />County). The attached copy of our Certificate of Title reflects that the property legal <br />records include only lot 55 and 56. <br />According to plat book records, sometime between 1963 and 1976, lots 55, 56 and 57 <br />were arbitrarily attached for tax purposes (see copy of attached plat prior to 1976 revision). <br />You have indicated that there was no record of owner permission granted for this <br />combination. <br />Upon your recommendation, we have applied for a lot subdivision. The Registrar of <br />Titles offlcer and our title insurance company attorney have vehemently argued that a <br />subdivision is not required in this case.
