MINUTES OF THE ORONO PLANNING COMMISSION <br />MEETING HELD ON JANUARY 20, 1998 <br />(#5 - #2330 Robert Beutler - Continued) <br />Lindquist said the concern is the structure being easily turned back to a residence, and the <br />City is trying to ensure that this does not occur. Vang noted that this has happened in the <br />past. <br />Smith informed Beutler that from a practical standpoint, the structure would be allowed a <br />tap with some simple type of heating unit. <br />Mr. Beutler said he would further discuss the matter with Council. <br />Lindquist moved. Smith seconded, to approve Application #2330 based on renewal of an <br />elapsed variance. Vote; Ayes 5, Nays 0. <br />(#4) #2315 C. DOUGLAS AND MARILYN HOLCOMBE, 1040 AND 1056 <br />LOMA LINDA AVENUE - Lot line rearrangement, and variances for lot area and <br />lot width - 7:22-7:38 p.m. <br />The Certificate of Mailing and Affidavit of Publication were noted. <br />The Applicants were present. <br />Dressier distributed pictures of the property being proposed for a lot line rearrangement. <br />The rearrangement would eliminate a problem where a portion of the driveway for 1040 <br />Loma Linda is on property owned by 1056 Loma Linda. It would also provide 1056 <br />Loma Linda with more lakeshore. The rearrangement would reduce the lot area and <br />width for 1040 Loma Linda Avenue and 1056 Loma Linda Avenue would increase in size. <br />Neither property meets the lot area and lot width requirements. While hardcover would <br />increase slightly on 1040 Loma Linda, the percentage would actually decrease for 1056 <br />Loma Linda Avenue due to additional lot area. The proposal would result in a more <br />functional lot line. <br />Van Zomeren informed the Planning Commission of a problem in the neighborhood due to <br />differing opinions from surveyors regarding lot lines. This controversy may affect the <br />property. Van Zomeren said the lot line rearrangement is an improvement of the existing <br />situation and recommends approval. <br />Lindquist asked who will decide which surveyor is correct. Gaffron said the six property <br />owners affected will have to join together in a land registration proceeding to come to a <br />conclusion. This is a long and expensive procedure. <br />Lindquist questioned whether approval of this application would affect the problem. Vang <br />said the setbacks may vary ’ by as much as 18". Van Zomeren >aid the lot line <br />rearrangement is internal to both lots so it can be conceptually approved.
