2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />While the property does not meet the lot area requirement, it is still allowed 1,500 s.f. or <br />15% of structural coverage, whichever is greater. In this case, 15% allows for the <br />greater amount of structural coverage. The enclosure exceeds the structural coverage <br />limits. <br />3. The variances, if granted, may alter the essential character of the locality. <br />The variances for average lakeshore setback and structural coverage may change the <br />character of the area. <br />4. <br />5. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Screened porches for residential purposes are allowed in this zoning district. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />The subject property is near the maximum allowable 15% of structural coverage. <br />There is no hardship for increasing beyond this limit. The location of the residence on <br />the lot is also consistent with adjacent properties. Allowing the structure to encroach <br />ahead of the average lakeshore setback line may have a negative impact on neighboring <br />views. <br />6.The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />The adjacent properties are aligned in a relatively straight line along the lakeshore. <br />These properties have decks, rather than enclosed porches. The deck on the property to <br />the south is considered a structure because it is more than 6' above ground level. It <br />is not an enclosed structure and is located lower than the subject property. It is not <br />detrimental to views.
