IS ITEI^ HAIBEEN <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 1914_________ <br />'■_r.l_^J:A^lleant shall remove 205 square feet of plastic sheeting <br />from underneath the rock on the north side of the house in <br />addition to the 623 square feet of blacktop already removed in <br />order to compensate for the 828 square feet of additional hard <br />cover created by the pool structure. Such plastic sheeting <br />removal shall occur prior to final inspection of the pool <br />structure. <br />2. Applicant shall submit revised pool structure plans coin <br />ciding with the survey showing an 18'x46' addition, prior, to <br />issuance of a building permit. <br />3. This approval is specifically for a one story structure <br />extending from the basement level of the house, and any future <br />addition of a story above the pool level will require a new <br />variance application. This condition does not prohibit applicant <br />from using the roof of the pool structure as a deck with standard <br />36” railing, but does prohibit enclosing of such deck. <br />4. Excavated material from the pool addition shall not be spread <br />in the 0-75' lakeshore setback zone, and grading around the pool <br />addition shall be limited to that necessary for the construction. <br />5. Authorities granted by this variance run with the property <br />not with the applicant, but are permissive only and must be <br />exercised by application for a building permit within one year of <br />the date of Council approval, or this variance will expire on <br />that date (January 27, 1987). <br />6. Violation of or non-compliance with any of the terms and <br />conditions of this variance shall constitute a violation of the <br />zoning code, shall automatically terminate any authority granted <br />herein, and shall be punishable as a misdemeanor. <br />7. The undersigned applicant has read, understood and hereby <br />agrees to the terms of this resolution and on behalf of himself, <br />his heirs, successors and assigns, hereby agrees to the recording <br />of this resolution in the chain of title of the property. <br />Adopted by the Orono City Council on this 27th day of <br />January, 1986. <br />ATTEST: <br />Mhry C.
