Since the bay window will be constructed over <br />an existing deck, the amount of hardcover will not increase. The only hardcover in the 0’ to 75’ <br />lakeshore setback are steps leading to the lakeshore, a retaining wall and 45 s.f. deck and shed. <br />There is a disproportionate amount of hardcover in the 250’ to 500’ lakeshore setback as this is <br />the "panhandle" portion of the yard that contains the driveway. <br />STATEMENT OF HARDSHIP <br />The applicants’ should be asked for their testimony regarding this issue. <br />Criteria for Determining Undue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property can continue to be put to a reasonable use in its current state.
