4. <br />5. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />A single family residence is permitted in the LR-IB zoning district. <br />The special conditions applying to the stnicture of land in question are peculiar <br />to such property or immediately adjoining property. <br />Most lots and residences in the area do not conform to current zoning district <br />requirements. The following table shows the approximate lot sizes for several of the <br />neighboring lots on Rest F oint Road, all of which have residences on them. <br />Address 1385 1390 1398 1386 1396 1395 1405 1400 1406 <br />Size <br />(Acres) <br />.34 .22 .21 .21 .2 .17 .12 .1 .1 <br />As this table demonstrates, the subject property is comparable in size to the neighboring <br />lots tha* currently and historically have had residences on them. <br />The lift station on the northeast portion of the lot is unique to this property on Rest Point <br />Road. <br />6.The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />7. <br />Most lots of similar size in tlie area already have residences on them. The subject <br />property has historically been ''acant. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />Sewer was made available to the property prior to current zoning district requirements. <br />While a sewer unit was not assessed, there is a service "y" at the sewer main in the street <br />as shown on Attachment J. This suggests there was the possible intent that a sewer stub <br />would be added in the future when a residence i.T constructed on the lot.
