CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 6973 <br />A RESOLUTION APPROVING <br />A CONDITIONAL USE PERMIT <br />PURSUANT TO MUNICIPAL ZONING CODE <br />SECTION 78-305 <br />AND <br />AN INTERIM USE PERMIT <br />PURSUANT TO MUNICIPAL ZONING CODE <br />SECTION 78-1726 <br />FILE NO. LA19-000019 <br />WHEREAS, on March 6, 2019, on behalf of the property owner Brackett Point <br />Property L.L.C., Christine Lake (hereinafter the "Applicant'), the vice president of Brackett Point <br />Property LLC, applied for a Land Use application including an Interim Use Permit (hereinafter <br />the "IUP"); and a Conditional Use Permit (hereinafter the "CUP") for the property addressed 1400 <br />Bracketts Point Road and legally described as: <br />Lot 1, Block 2, Southways, Hennepin County, Minnesota (hereinafter the <br />"Property"); <br />WHEREAS, the Applicant has made application to the City of Orono for an IUP <br />pursuant to Orono Municipal Zoning Code Section 78-1726 to allow the export of approximately <br />9,500 cubic yards of material from the Property; and disturbance of approximately 5,800 cubic <br />yards of material within the 75 -foot setback to facilitate the construction of a new residence on <br />the property; and <br />WHEREAS, the Applicant has made application to the City of Orono for a CUP <br />pursuant to Orono Municipal Zoning Code Section to permit a guest house on the Property; and <br />WHEREAS, on April 15, 2019, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, on April 15, 2019, the Planning Commission recommended approval <br />of the IUP and CUP for the Property; and <br />WHEREAS, on May 13, 2019, the City Council reviewed the application and the <br />recommendations of the Planning Commission and City staff; and <br />
