The <br />driveway is proposed to be constructed as close as 12 feet from the wetland where a 35-foot setback is required. <br />A portion of the new driveway is also proposed to be constructed within an existing sanitary sewer easement. <br />If the City engineer deems it appropriate, an encroachment agreement can be drafted to address the new <br />driveway and the existing boulder wall improvements within the easement. <br /> <br />Planning Commission Recommendation <br />On August 17, the Planning Commission held a public hearing and reviewed the application including the <br />evidence submitted and testimony from the public. Please see the attached draft minutes from the Planning <br />Commission meeting for more detail regarding the public comments. Following the public hearing the <br />Commission voted 5 to 1 on a motion to approve the setback variance with the following conditions: <br />1. Applicant shall comply with all of the permitting requirements of the MCWD – specifically the <br />wetland, erosion control, and floodplain alteration rules. <br />2. Applicant shall comply with the recommendations of the City Engineer prior to placement on the City <br />Council agenda. <br />3. Applicant shall enter into an encroachment agreement with the City to addresses the existing and <br />proposed improvements within the sewer easement. A draft agreement will be provided to you prior <br />to the City Council meeting for review. <br /> <br />Planning Staff Recommendation <br />Staff recommends approval of the wetland setback to construct the driveway. Staff recommends the <br />proposed grading be revised to provide stormwater volume mitigation on the northwest corner of the <br />proposed improvements. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider adopting or amending the approval resolution. <br /> <br />List of Exhibits: <br />Exhibit A.
