Date Application Received: 07/20/15 <br />Date Application Considered as Complete: 08/03/15 <br />60-Day Review Period Expires: 10/02/15 <br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 8 September 2015 <br />Item No. 8 <br />Department Approval: Administrator Approval: Agenda Section: <br />Name: Melanie Curtis mcc RJO Planning <br />Title: Planner <br />Item Description: #15-3767, Jon Ressler, 3683 North Shore Dr, Variances, Resolution <br /> <br />Application Summary: <br />The applicant is proposing to construct an attached garage addition and make modifications to the existing <br />one-level home resulting in a 2 ½ story home; side, lake and average setback variances as well as hardcover <br />and structural coverage variances are required in order to do so. <br /> <br />The existing home is situated as close as 35 feet to the OHWL of Lake Minnetonka and 5 feet ahead of the <br />average lakeshore setback. There is an existing one-level 1,200+ square foot home and 460 square foot <br />detached garage on the property. There is a crawl space under the home. At 1,781 square feet, the property <br />currently exceeds the allowed 1,500 square foot structural coverage allowance by 281 square feet; the <br />hardcover level is currently at 54% where 25% is allowed and slight increase to 56% is proposed (188 square <br />feet additional hardcover). The applicant’s proposal will reduce structural coverage slightly by 9 square feet <br />(1,772 square feet proposed). <br /> <br />Planning Commission Recommendation <br />On August 17, 2015, the Planning Commission held a public hearing and reviewed the application including <br />the evidence submitted. Following the public hearing the Commission voted 5 to 1 in favor of a motion to <br />approve the variances as requested with the following conditions: <br />1. Applicant shall comply with the permitting requirements of the MCWD. <br />2. The top floor of the proposed home shall comply with the City’s definition of “half story”; no height or <br />number of stories variances are being granted. <br />3. Applicant shall comply with the recommendations of the City Engineer and Building Official during the <br />permit review and construction process. <br />4. Revised hardcover calculations shall be submitted to properly report the hardcover existing within the <br />75-foot setback. Revised calculations were submitted (see Exhibit D). <br /> <br />Planning Staff Recommendation <br />Staff recommends approval; a draft approval resolution has been provided for Council’s consideration. <br /> <br />COUNCIL ACTION REQUESTED <br />Council should consider adopting or amending the approval resolution. <br /> <br />List of Exhibits: <br />Exhibit A.
