MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, August 10, 2015 <br />7:00 o’clock pm. <br />_____________________________________________________________________________________ <br /> <br />Page 25 of 32 <br /> <br />9. #15-3754 CITY OF ORONO, TEXT AMENDMENT RELATED TO APPROVAL <br />EXTENSIONS (continued) <br /> <br />Gaffron stated if someone wants to extend it for a couple of years, he is fine with that, but once it goes to <br />three or four years, in his view some of the neighbors might have changed and the process should start <br />over. <br /> <br />Walsh stated it gives the Council a firm standard to follow. <br /> <br />Walsh moved, Printup seconded, to adopt ORDINANCE NO. , THIRD SERIES, an Ordinance <br />Amending the Orono Municipal Code by Amending Sections 82-117, 78-128, 7-149, and 78-918 <br />Regarding the Number of Extensions Associated with Approved Projects, three total years from <br />date of approval. VOTE: Ayes 5, Nays 0. <br /> <br />10. #15-3755 CITY OF ORONO, AMEND ZONING ORDINANCE TEXT: SECTION 78-71 <br />(c) (3) EXPANDING OF NONCONFORMING STRUCTURES <br /> <br />Gaffron stated this amended zoning ordinance text essentially makes it very clear from a language <br />standpoint what the City means by expansion of a nonconforming structure. The new language also adds <br />clarity to what is meant by “increase the nonconformity.” The proposed language was recommended by <br />the City Attorney and reflects how the City has consistently interpreted and enforced its nonconforming <br />structure regulations in the past. <br /> <br />The Planning Commission recommended adding the wording “but no limited to” in the list of site features <br />subject to the definition in the first paragraph of (3). <br /> <br />Gaffron noted this change came about because of an application on Tanager Lake. <br /> <br />Mattick stated if someone is granted a variance to a side setback, he does not view that house as then <br />being nonconforming, but if they want to expand the structure, it would require a variance. If there is a <br />home that is located five feet from the property line and the City changed the setback to 10 feet, then it <br />would be nonconforming. Mattick stated adding a deck to that structure would be expanding that <br />nonconformity. Mattick stated this language helps clarify those types of situations and what has been the <br />past practice of Staff. <br /> <br />Levang moved, Walsh seconded, to adopt ORDINANCE NO. , THIRD SERIES, an Ordinance <br />Amending Chapter 78, Section 71 of the Orono City Code Regulating Nonconforming Structures <br />and Uses.
