Goldsmith noted the applicants have <br />not previously mentioned that there is this dispute and that he was not aware of it until after the <br />Planning Commission meeting when they placed a stake on his side of the fence. <br /> <br />Hanish stated they have rechecked the boundary lines and they match the legal description and <br />the deed that was given to the Underdahls when they purchased the property. Hanish stated in <br />their view they have the correct boundary line. <br /> <br />Hanish indicated he did have a conversation with Mr. Goldsmith prior to tonight’s meeting and <br />that he is committed to having a meeting on the site to see if there is any common ground that <br />can be reached. <br /> <br />Cornick asked if the survey that verified the first survey was done by the same person. <br /> <br />Hanish stated the property to the north was actually recently re-platted and that they used the <br />legal description from that plat as well. Hanish stated using that boundary line, they came back <br />to the exact same points on the common boundary line. <br /> <br />Walsh moved, Cornick seconded, to adopt RESOLUTION NO. 6528, a Resolution <br />Granting Preliminary Plat Approval for Subdivision of the property located at 185-225 Old <br />Crystal Bay Road North. VOTE: Ayes 5, Nays 0. <br /> <br />*8. #15-3750 JEFF VONFELDT AND ELAINE WYATT, 1990 SHADYWOOD ROAD, <br />VARIANCES – RESOLUTION NO. 6529 <br /> <br />Levang moved, Cornick seconded, to adopt RESOLUTION NO. 6529 , a Resolution <br />Granting Setback Variances from Orono Municipal Code Sections 78-350 and 78-1279, for <br />the property located at 1990 Shadywood Road. VOTE: Ayes 5, Nays 0. <br /> <br />9. #15-3756 CITY OF ORONO, AMEND CITY CODE SECTION 86-68 SURVEY <br /> REQUIREMENTS – ORDINANCE NO. 152 <br /> <br />Community Development Director Barnhart stated a couple of weeks ago he presented a <br />preliminary draft of the ordinance that talks about the survey requirements. At that meeting the <br />Council expressed two concerns: One being the accuracy and age of the as-built survey and <br />hardcover. <br />
