On May 11th, the Council amended the requirements of a permit application. <br />These changes included allowances for a site plan to be prepared by a licensed professional to be <br />submitted in the place of a survey for building and grading permits; and provided allowances for <br />an exemption for projects of smaller magnitude that meets certain defined minimum criteria. <br />During the review of that ordinance there were some concerns that the ordinance did not <br />adequately address the needs of lots less than 2 acres. <br /> <br />In response, staff has prepared an ordinance for discussion purposes that allow the flexibility, as <br />well as minimum information necessary to responsibly review an application. The proposed <br />language provides flexibility for smaller projects that are well within the required setbacks on <br />any lot that has an as-built survey on file. Further, it is staff’s goal to maintain a consistent level <br />of requirements, to avoid a number of differing regulations that may confuse users. <br /> <br />Key points: 1. As built survey. In situations where an as-built survey is not present, a survey or <br />site plan will be required. <br /> 2. Building vs structures. Building foot print (Decks, sheds, building additions) <br />would need to be less than 200 square feet. Non-building structures (patios, etc) are <br />not restricted by the size limitation. <br /> 3. Average Lake Shore setback. Average Lake setback will impact building <br />location, and is typically shown on a survey. An as-built survey is a snap shot in <br />time, and neighboring properties may have made modifications that impact the line <br />on the subject property. Rather than exclude all lake shore lots, the ordinance seeks <br />evidence that average lake shore line is met. This evidence is expected through <br />aerial photos or site inspections. <br /> <br />COUNCIL ACTION REQUESTED: <br />Staff seeks direction as to desired modifications to the ordinance as presented.
