Applicant: John Earl Stewart <br />Activity:Educational Materials <br />Date:To be determined upon Council approval <br />Time:8:00 a.m. – 8:00 p.m. <br />Staff has reviewed the applications and completed the background investigation to issue a solicitor’s <br />license to John Earl Stewart of Southwester Advantage. <br />Orono’s code currently allows a peddler, transient merchant or solicitor to be licensed initially for 10 <br />days, with the option for the City Council, at its sole discretion, to grant an extension for up to 50 <br />additional days. John Earl Stewart has requested an extension of the solicitor’s license. Staff <br />recommends approval of the license and the extension request. <br />Staff would also note that prohibited activities for solicitors include: <br />(1) Calling attention to his or her business or items to be sold by means of blowing any horn or <br />whistle, ringing any bell, crying out, or by any other noise, so as to be unreasonably audible <br />within an enclosed structure. <br />(2) Obstructing the free flow of either vehicular or pedestrian traffic on any street, alley, sidewalk <br />or other public right-of-way. <br />(3) Conducting business in a way so as to create a threat to the health, safety and welfare of any <br />individual or the general public. <br />(4) Conducting business before 8:00 a.m. or after 8:00 p.m. <br />(5) Failing to provide proof of license and/or identification, when requested; or using the license <br />of another person. <br />(6) Claiming to have the endorsement of the city solely based on the city having issued a license to <br />that person. <br />(7) Remaining on the property of another when requested to leave, or to otherwise conduct <br />business in a manner a reasonable person would find obscene, threatening, intimidating or <br />abusive. <br />(8) Entering property that is marked with a sign or placard with the words “Peddlers or Solicitors <br />Prohibited” or comparable statement. <br />COUNCIL ACTION REQUESTED: <br />Consider a motion to approve the request for an extension to allow solicitation for an additional 50 <br />days for Southwestern Advantage. <br />14 <br />Entire Council Packet 05/26/15 [Page 357 of 378]
