MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, September 14, 2015 <br />7:00 o'clock p.m. <br />11. #15-3772 ROBERT MILLER, 60 SMITH AVENUE, VARIANCES — RESOLULTION NO. <br />6539 (continued) <br />Oberpriller stated he is very familiar with the issues relating to the side setbacks and that they are <br />sensitive to that. Oberpriller stated they tried not to over scale the house either from a side yard or <br />encroachment point of view. Oberpriller stated they are not able to do anything about the current setbacks <br />outside of tearing the existing structure down, which is not economically viable in this case. <br />McMillan stated she understands the desire for a functional second story but the big question is the <br />vertical massing and the impact that will have on the neighboring structures. <br />Curtis displayed pictures of the property and neighboring lots. <br />McMillan asked how this project will impact the neighbor's deck. <br />Oberpriller noted the garage will be pulled forward and that the picture on the overhead was taken from <br />the roof of the neighbor's house. <br />Miller stated if the neighbors are on the deck, they would be looking at their home and not his residence. <br />McMillan stated she cannot tell from the plan how the new roof and windows will impact the neighbors. <br />Oberpriller stated they would be looking at the garage if they are on the deck. Oberpriller indicated they <br />are proposing a gable roof to help limit the impact. <br />McMillan stated she was attempting to visualize what the impact would be to the neighbors. <br />Bonnett stated they were looking for ways it could be impacted and with fewer variances. <br />Oberpriller stated they would not be able to see any of the windows. Oberpriller indicated the white <br />triangle depicts the eave line. <br />Walsh stated the second story would be going up ten feet. <br />Oberpriller stated it is not their intent to cause any disruption to the neighbors and that they are trying to <br />be sensitive to both neighbors' concerns. Oberpriller stated the Millers will not be able to look down onto <br />the neighbor's deck and that the height of the structure would be approximately 30 to the peak of the roof. <br />Walsh stated the ridge line is going from 21 to 30 feet. <br />Levang asked whether there will be living space above the garage. <br />Oberpriller indicated it will be storage space. <br />Bonnett stated as long as their windows are not looking down at their windows, they would be fine with <br />it, but that in his view there are other ways to do the project. <br />Page 28 of 39 <br />
