Keaveny was advised that <br />the City would not consider just the rezoning of his property. Tract B, <br />RLS 1422. (Remember SPOT ZONING). In that earlier discussion, the <br />existing zoning was deemed unrealistic. The existing physical site <br />and pattern of ownership are in complete conflict with the true intent <br />of the shopping center district. The property has two owners, not the <br />single control required of the zoning. The property is limited in area. <br />Required under single control - 2 acres <br />Existing Tract A - 1 acre <br />Existing Tract B - 1.5 acres <br />The owners realize that in case of a disaster and the entire existing <br />facility is destroyed, that they must rebuild subject to the standards <br />of the current zoning as follows: <br />a) 60* setback from all property lines <br />b) 100* setback from property lines abutting residential zone - How <br />would you rebuild on Tract A - it would be impossible. <br />All uses permitted in the B-3 district are also approved for the B-1 <br />zoning district.
