CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 7372 <br />1 <br />A RESOLUTION <br />APPROVING A VARIANCE FROM <br />MUNICIPAL ZONING CODE <br />SECTION 78-1279 <br />FILE NO. LA23-000021 <br /> WHEREAS, on April 19, 2023, John and Leslie Cadle (hereinafter the “Applicants”), applied <br />for a variance from the City Code for the property addressed 2691 Ethel Avenue and legally <br />described as: <br />Tract C, Registered Land Survey No. 115, Hennepin County, Minnesota, <br />except that part thereof lying Southeasterly of a line drawn from a point on the <br />Southwesterly line of said tract distant 15 feet Northwesterly from the most <br />Southerly corner of said tract, through the Northeasterly corner of said tract. <br />Together with an easement for right of way for road purposes over that part of <br />Block 5, Winship's Subdivision of Lot Number One (1 ), Spring Park, 2nd Division, <br />lying Southwesterly of the premises above described and between the Northerly <br />extension of the Easterly line and the Westerly line of Ethel Avenue (now Tract E, <br />Registered Land Survey No. 115) and also together with the right to use of shore <br />for private bathing and dock in front of a strip of land 15 feet in width, lying <br />Southeasterly of and immediately adjacent to the Southeasterly line of the <br />premises hereinabove first described, and which 15 foot strip runs Northeasterly <br />along the Southeasterly line of said premises from the Easterly extension of the <br />Southwesterly line of said premises to the shore of Carmen's Bay Lake <br />Minnetonka; (now Tract B, Registered Land Survey No. 115), Hennepin County, <br />Minnesota (hereinafter the “Property”); <br /> WHEREAS, the Applicants have made application to the City of Orono for variances <br />from Orono Municipal Zoning Code Section 78-1279 to allow construction of improvements to <br />the existing home lakeward of the average lakeshore setback line; and <br /> WHEREAS, on May 15, 2023, after published and mailed notice in accordance with <br />Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br /> WHEREAS, on May 15, 2023, the Planning Commission recommended approval of the <br />variances; and
