Please <br />#783 - I.D. Caples April 12, 1984 <br />Page 2 <br />The property is located on a very busy curve. Rember the road at the <br />north is Tonkaview not Park Avenue. Park Avenue is probably located <br />at the grassed-in old driveway access where the utility poles have been <br />placed. Access to this site is crucial. The lot should be staked along <br />the Park Avenue lot line. <br />Would it be more feasible to seek access off Tonkaview via the informal <br />driveway (located within unimproved platted right of way) and permit <br />no access off the County Road along this curve area. Note, Lots 8, 9, & <br />10 to the north are under common ownership and undeveloped. The City <br />would agree to a vacation of a portion of Park Avenue if the applicant <br />is able to acquire additional lots to the north. <br />Sewer is available and the original assessment payment will be paid to the <br />City over the ten-year period. <br />The house has been placed on the site meeting all required setbacks. <br />Note - 35' from travelled rjad. Where's the garage? This review should <br />assure that we can also include a garage on the site without the need <br />of a setback variance. <br />Two lots combined as a building site was a typical development pattern <br />in earlier years, but in recent years, the pattern has been to combine <br />three or four lots as a building site. <br />The applicant has not designated an access nor included an access permit <br />review by Hennepin County. If the Planning Commission is considering <br />approval of the variance as proposed, I would recommend tabling the <br />application until staff can review the access issue with Hennepin County <br />and the possibility of using Tonkaview and Park Avenue as access. City <br />should also consider vacation of Park Avenue (westerly 195*) to discourage <br />public use of the unimproved platted right of way. <br />If Planning Commission wishes to deny this application, please use Section <br />10.08, Subdivision 3(a) of the zoning chapter for the necessary findings. <br />In addition, the following findings can be made: <br />1. Applicant purchased property fully aware of the risk involved <br />2. Property severely limited by location of travelled County road along <br />southwest of Lot 10.
