Zoning Administrator rr ft* <br />October 13, 1976 <br />i y <br />SUIUECT: Rolx?rt Solie - 1035 North Arm Drive <br />Conditional Use Permit - Crading and Tilling <br />This application is persuant to Section 31.700 and 31.705 requiring a Conditional <br />Use Permit for grading and filling of any land, esix^cially lakeshore property, <br />within Orono. In this case, the work in question has been done, and staff has <br />instructed Mr. Solie to seek Council approval. <br />Oi August 8, 1976, staff received a complaint of work in progress on this property. <br />Investig,ation rwealed a major excavation done with earth filled near to the shore <br />and siltation of the water evident. A stop work order was posted and a tag was <br />issued. Mr. Solie was advised to make a permit application and to also seek <br />approval from the other agencies. <br />An application apparently was made to the MCiVD because we liave a copy of a letter <br />from tliem to Mr. Solie on August 27, 1976, approving his request. Additional work <br />was then apparently done prior to September 9, 1976 (without Orono Staff knowledge) <br />with an MOVD inspection as per their letter to me on .September 29, 1976.. 'fhe <br />Conditional Use Permit application was not made initil September 20, 1976 (initially <br />incomplete; not updated until October 1, 1976) after a renewed request following <br />staff's discovery of additional work having been done. At this point, the <br />Municipal Court has continued this case until the Council shall take action on <br />this application. <br />The work done inclutles cutting down a high bank and grading the dirt down toward <br />lake level in one comer of the lot. TIic loiver level was filled up to 5 ft. high <br />and to within 10 ft. of the suimer water level. A creosoted tic retaining wall <br />was erected on the lower end and apnraximately 2 dozen small trees have been <br />planted, 'fhe slope has been seeded, hliile the drawing submitted is not technical, <br />the nature of tlie work can easilv be seen on site. <br />nA'.MNC Cl'MSSI''''! - 'lovombcr 1, 1976 <br />T!ie Zoning Ailninistrator explained the current status of th.c nrojoct in relation to <br />t!ic proi'josal as subritted.
