Zoning Administrator rr ft* October 13, 1976 i y SUIUECT: Rolx?rt Solie - 1035 North Arm Drive Conditional Use Permit - Crading and Tilling This application is persuant to Section 31.700 and 31.705 requiring a Conditional Use Permit for grading and filling of any land, esix^cially lakeshore property, within Orono. In this case, the work in question has been done, and staff has instructed Mr. Solie to seek Council approval. Oi August 8, 1976, staff received a complaint of work in progress on this property. Investig,ation rwealed a major excavation done with earth filled near to the shore and siltation of the water evident. A stop work order was posted and a tag was issued. Mr. Solie was advised to make a permit application and to also seek approval from the other agencies. An application apparently was made to the MCiVD because we liave a copy of a letter from tliem to Mr. Solie on August 27, 1976, approving his request. Additional work was then apparently done prior to September 9, 1976 (without Orono Staff knowledge) with an MOVD inspection as per their letter to me on .September 29, 1976.. 'fhe Conditional Use Permit application was not made initil September 20, 1976 (initially incomplete; not updated until October 1, 1976) after a renewed request following staff's discovery of additional work having been done. At this point, the Municipal Court has continued this case until the Council shall take action on this application. The work done inclutles cutting down a high bank and grading the dirt down toward lake level in one comer of the lot. TIic loiver level was filled up to 5 ft. high and to within 10 ft. of the suimer water level.
