Zoning AcJministrator Vv <br />DATl:: <br />.mJECT: <br />October 13, 1076 <br />Rolxjrt Solie - 1085 North Arm Drive <br />Conditional Use Permit - Crading and Pilling <br />This application is persnant to Section 31.700 and 31.705 requiring a Conditional <br />use Permit for grading and filling of any land, especially lakeshore property, <br />within Orono. In this case, the work in question has been done, and staff has <br />instructed Mr. .Solie'to seek Council approval. <br />On August 8, 1976, staff received a complaint of work in progress on this property <br />Investig.ation revealed a major excavation done with earth filled near to the shore <br />^d siltation of tlie water evident. A stop work order was posted and a tag was <br />issued. Mr. .Solie was advised to make a permit application and to also seek <br />approval from the other agencies. <br />An application apparently was made to the MGVD because we have a copy of a letter <br />from tiiem to Mr. .Solie on August 27, 1976, approving his request. Additional work <br />was then apparently done prior to September 9, 1976 (without Orono Staff knoivledge) <br />with an MOVD inspection as per tlieir letter to me on .September 29, 1976. The <br />Conditional Use Pennit application was not made until September 20, 1976 (initially <br />incwnplete; not updated until October 1, 1976) after a renewed request following <br />staff's discovery of additional work having been done. At this point, the <br />Minicipal Court has continued this case until the Council shall take action on <br />this application. <br />The work done includes cutting down a high bank and grading tlic dirt down toward <br />lake level^ in one comer of the lot. Tlie lower level was filled up to 5 ft. high <br />and to wi+! in 10 ft. of the summer water level. A creosoted tie retaining wall <br />was erected on the lower end and approximately 2 dozen small trees have been <br />planted. The slope has been seeded. Miile the drawing submitted is not technical, <br />the nature of the work can easilv be seen on site. <br />1-'I
