Chapter 80 of the flunicipal Code of Orono is hereby <br />amended as follows: <br />80,010 Definitions, (a) "Firearms” shall mean any device <br />from which is propelled any projectile or bullet by <br />means of explosions or p.as. <br />(b) Military type weapon" shall mean <br />any firearm or other weapon such as bazookas, machine <br />^uns, mortars or prenades. <br />(c) "Club" shall mean any p.roup of <br />persons having a rot^ular inenibcrship and improved or <br />permanent facilities for target or trap and skeet shootinf;, <br />80.020 Possession. No persvTii shall own, keep, carry or <br />have possession of any military type weapon within the <br />Village of Orono except persons on active duty as a member <br />of a United States riilitary unit. <br />80.021 Transport of Firearms. No person shall transport <br />any firearms within the Villaee of Orono unless such <br />firearm is dismounro«l, broken apart, or carried in a <br />closed case or is othmx'ise incanablc of beim* readily <br />discharged. This soct.ion sliaJl not apnly to authorized <br />law enforcement officers if such firearm is carried <br />while on duty or in accordance with the rules of their <br />department. <br />80.030 Shooting. Restricted. No nei son shall discharge any <br />firearm within the vrjlage of Orono except (a) as other­ <br />wise provided in tliis Chaiiter, (b) unless dischar.ged in <br />lawful defense of person or property, or (c) be is a <br />duly authorized law enforcement officer in the performance <br />of his duty. <br />80.040 Permits. Permits authorizing the use of firearms <br />shall be granted by the Village Clerk for the purpose and <br />to the persons stated in this section if he determines <br />that such use is not. contrary to the public safety or <br />welfare and if the use thereof w.onld not constitute a <br />. hazard to persons • nroperty or would not create a nuisance. <br />The Clerk may attain conditions to the exorcise of the <br />permit for the protection of the nubl ic interest or the <br />interests surroundinp landowners if he deems it advisable. <br />Permits, Procerlure. ’liic Clerk may require notice <br />be given to surrouml ing. landowners and an opportunity for <br />them to object prior to the issuance of a permit, but such <br />objections shall not rcnuirc tlie permit to be withheld. <br />Any person may appeal the denial of a permit to the Village <br />Council. ^ <br />; <br />-
