�y,913 <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO, 5 <br />A RESOLUTION GRANTUI G VARIANCES <br />TO MUNICIPAL ZO-N-ING CODE <br />SECTIONS 78-282, 78-305 (B), 78-1288 (B) <br />FILE NO. 03-2917 <br />WHEREAS, Winfield R. Stephens III and Nancy Stephens, husband and <br />wife, (hereinafter "the applicants") are the o-vxners of the property located at 350 <br />Crestview Avenue within the City of Orono (hereinafter the "City") and legally described <br />as follows: <br />Lot 6, 7, and 8, and that part of Lot 5. Block 6 BAYSIDE ADDITION TO LAKE <br />MINNETONKA, lying south of the north 40 feet thereof. <br />(hereinafter the "property"); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for variances to Orono Municipal Zoning Code Section 78-282, 78-305 (B), and 78-1288 <br />(B) to allow construction of a new residence on a property that is 0.455 acres in size <br />when 2 acres is normally required and for the structure to be setback 30' from the front <br />property line when 50' is required, 10' from the side property line when 30' is required <br />and, 30' from the rear property line when 50' is required and also to allow 45% <br />hardcover in the 75-250' zone when 25% is normallv allowed. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #03-2917. <br />2. The property is located in the LR — I A, One Family Lakeshore Residential <br />Zoning District, which requires a minimum lot size of 2 acres. The <br />subject property is 0.455 acres in size. <br />3. The Planning Commission reviewed this application at a public hearing <br />held on August 18. 2003 and November 17, 2003 and recommended <br />Metro Legal Services Inc. <br />Page 1 of 6 BOX 491 <br />
