MEMORANDUM <br /> Date: September 20, 2005 <br /> To: Renae Clark, Minnehaha Creek Watershed District <br /> From: Janice Gundlach, City Planner, City of Orono <br /> RE: Faxed Memo of 9-2-05 to Lyle Oman RE: 560 Big Island <br /> I apologize for the delayed response; however I would offer the following comments with <br /> regard to improvements proposed for property located at 560 Big Island (#'s <br /> corresponding to the written request submitted by Rick Palm): <br /> 1) Grading, filling, or excavating within 75' of the OHWL of Lake Minnetonka is <br /> prohibited. City Code Section 78-1286 (b) allows for administrative approval to <br /> grade, fill, or excavate less than 10 cubic yards. This requires approval of a <br /> permit by the building official and submittal of detailed cross-section views to <br /> verify the 10 cubic yard limit. A request for a sand blanket would be subject to <br /> the 10 cubic yard limit. <br /> 2&3) The City would defer any requests for improvements lake-ward of the 929.4' <br /> elevation to the Minnehaha Creek Watershed District. The request for boulders <br /> (not rip rap) behind the cattails to separate the lawn from the cattails would be <br /> also not be permitted as boulders would be considered hardcover and no <br /> hardcover is permitted within 75' of the OHWL of Lake Minnetonka <br /> 4) Refer to the response in #1 above. <br /> 5) Boulders for a fire-pit constitute hardcover where no hardcover within 75' of <br /> Lake Minnetonka is permitted. A fire-pit outside the 75' setback would be <br /> permitted so long as the 75'-250' hardcover zone does not exceed 25% total <br /> hardcover. <br /> 6) The City would welcome the planting of grass seed in an effort to establish some <br /> ground cover vegetation. <br /> Also, City staff inet with Mr. Palm on the property prior to this permit request. During <br /> that on-site meeting Mr. Palm was focused on tree removal, particularly within the <br /> adjacent wetland buffer. I mention this only as matter of fact, as no tree removal within <br /> the wetland buffer seems to have been requested from you. <br /> Should you have further questions regarding the City's position on the improvements <br /> requested, I can be reached at 952-249-4623.
