0 CITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> G NO. 7221 <br /> �4 kES H Oi'`t <br /> A RESOLUTION <br /> APPROVING VARIANCES FROM <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-330 <br /> FILE NO. LA21-000051 <br /> WHEREAS, on July 21, 2021, Robert Linden Construction (the "Applicant"), applied <br /> for variances from the City Code for the property addressed 1074 Loma Linda Avenue and legally <br /> described as: <br /> Lot 7, Loma Linda, Hennepin County, Minnesota (hereinafter the"Property"); <br /> WHEREAS, the Applicant made application to the City of Orono for variances to <br /> Orono Municipal Zoning Code Section 78-330 to allow a 16 foot rear setback and a 1.2 foot side <br /> setback, where 30 feet and 7.5 feet are required, in conjunction with construction of an addition <br /> connecting the detached garage to the home; and construction of a second story over the garage; <br /> and <br /> WHEREAS, on September 20, 2021, after published and mailed notice in <br /> accordance with Minnesota Statutes and the City Code, the Planning Commission held a public <br /> hearing, at which time all persons desiring to be heard concerning this application were given the <br /> opportunity to speak thereon; and <br /> WHEREAS, on September 20, 2021, the Planning Commission recommended <br /> approval of the variances; and <br /> WHEREAS, on October 11, 2021, the City Council reviewed the application and <br /> the recommendations of the Planning Commission and City staff and tabled the application citing <br /> concerns with the substandard side yard setback; and <br /> WHEREAS, on April 29, 2022, the Applicant provided revised plans for Council <br /> review reflecting a 3.5 foot side setback where a 1.2 foot setback exists and continued to request <br /> a 16 foot rear setback for additions to the home; and <br /> WHEREAS, on May 9, 2022, the City Council reviewed the revised plans and <br /> voted 4 to 0 to direct staff to draft an approval resolution; and <br /> NOW,THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br /> hereby approves the revised setback variances as described above based on one or more of the <br /> following findings of fact concerning the Property: <br /> 1 <br />
