The proposed location of the structure will not require the removal of <br /> mature trees within the lakeshore yard. Applicant has agreed to install <br /> plantings along east side lot line to minimi7e visual impact of driveway <br /> - and side garage door. <br /> C. The properry exceeds the area and width requirements. <br /> D. No other variances are required for the proposed improvement. <br /> E. The former residence was also located in front of the average lakeshore <br /> setback line. � <br /> F. The higher elevations and existing mature plantings along the north lot <br /> line will minimi�e impact of lakeshore views of residence at 2684 Casco <br /> Point Road. It is also noted that a garage exists to the south side of the . <br /> • residence with no view windows to the lakeshore. <br /> 4. The City Council fmds that the conditions existing on this properry are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, -but is necessary to alleviate a <br /> demonstrable hardship or diff'iculty; is necessary to preserve a substantial properry <br /> . right of the applicant; and would be in keeping with the spirit and intent of the <br /> Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered. this application including the findings and <br /> � recommendations of the Planni.ng Commission, reports by Ciry staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety and <br /> welfare of the community. . <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the findings noted above, the Orono City Council <br /> hereby grants a variance to Municipal Zoning Code Section 10.22, Subdivision 1 (B) to permit <br /> the placement of a new principal residence in front of the average lakeshore setback line, subject <br /> to the following conditions: <br /> • � <br /> Page 2 of 4 <br /> Fam5005 askOrono <br />
