Staff believes the proposed use will <br />not cause any excessive traffic and the parking needs will be satisfied by the <br />existing shared parking lot. The Planning Commission should determine if a <br />condition should be placed on the conditional use permit to stripe any parking <br />spaces that are not currently striped. <br />13) Designed to take into account the natural, scenic, and historic features of the area <br />and to minimize environmental impact; No exterior or site modifications are <br />proposed as part of the new restaurant use. This criterion is met. <br />14) All exterior lighting shall be so directed so as not to cast glare toward or onto the <br />public right-of-way or neighboring residential uses or districts; No changes to the <br />exterior lighting of the site is proposed. This criterion is met; and <br />15) Not detrimental to the public health, public safety, or general welfare. The proposed <br />restaurant use will not be detrimental to the public health, safety or general <br />welfare. The addition of a new restaurant business is positive for the community. <br />This condition is met. <br /> <br />A CUP may be granted subject to such conditions as the Council may prescribe. Additionally, <br />a CUP shall remain in effect as long as the conditions imposed by the City Council are <br />observed, but nothing in this section shall prevent the city from enacting or amending official <br />controls to change the status of conditional uses. <br /> <br />Conditional Use Permit Analysis <br />Staff finds the applicant’s request to open a new restaurant that serves liquor at 2160 Wayzata <br />Boulevard West to be an appropriate use for the site. The current multi-tenant building has an <br />existing catering kitchen. The applicant plans to use and upgrade this kitchen and take over two <br />vacant tenant spaces for use of a dining room area. No exterior modifications are proposed as this <br />time. The use of a restaurant in this area seems compatible with the neighboring tenants which <br />operate during the day and the anticipated peak times for the restaurant is in the evenings. <br /> <br />Public Comments <br />No public comments have been received. <br /> <br />Issues for Consideration <br />1. Does the Planning Commission find that the CUP, if granted, will not alter the <br />essential character of the neighborhood? <br />2. Does the Planning Commission find it necessary to impose conditions in order to <br />mitigate the impacts created by the grant ing of the requested CUP? <br />3. Does the Planning Commission find it necessary to impose conditions related to <br />parking such as the requirement of striping the parking spaces ? <br />4. The applicant is proposing to bring a new dumpster to the site. Should a dumpster <br />encloser be required with the application? <br />5. Are there any other issues or concerns with this application? <br /> <br />Planning Staff Recommendation <br />Planning Staff recommends approval of the Condition Use Permit (CUP) with the condition to <br />stripe the parking lot. <br />
