4
o : 6
kEeH0
December 20, 1993
Mr. Don P. Gamble, III
Edina Realty
1120 East Wayzata Blvd.
Wayzata, Minnesota 55391
Re: Outlot C. Painter's Creek
Dear M:. Gamble:
CITY of ORONO
Municipal Offices
Street Address: Mailing Address:
2150 Kelley Parkway P O. Box 66
Orono. MN 55356 Crystal Bay, MN 55323 0056
Your latest in4uiry contemplates that land proposed to he dedicated for density credit as part of
a planned :esidential development (PRD) c,•uld be located elsewhere than within the parcel being
developed.
The City considered Outlot A of "Painter's Creek" as being contiguous with Lots I through 10
and Outlot B. The only "noncontiguity" is the 30' corridor platted as access to the Luce Line
for Outlot C, but remember that all of this land was part of a single 75 acre property and no "off
site" land was used for credit.
The PRD code (Section 10.32. attached) does not specifically address whether dry buildable [arid
to be used as density credit can he off site. This is left to the discretion of the Council. I can
only speculate that 1) such land would have to be in the same zoning district; and 2) such land
would h, -,,,e to be concurrently dedicated per Section 10.32. Subd. 4 and 5.
Such an off site density credit has not been attempted in Orono to -date.
Call or write if you have further questions.
Sincereelly,
`
Michael P.
