Q9-3433 <br /> WHEREAS, the City of Orono is a municipal corporation organized and existin� <br /> under the laws of the State of Miruiesota; and <br /> WHEREAS,Richard Hanson,the owner of 340 Bi�Island in the City of Orono,has <br /> petitioned for vacation of a poi�ion of Meta-Comet Avenue adjacent to his pi-operty; and <br /> VVHEREAS,after due published and posted notice, a public hearing was held by the <br /> Orono Plaiulin� Commissioi7 on November 16, 2009, re�arding said vacation and all i�lterested <br /> persons were given an opportunity to be l�eard; and <br /> WHEREAS, immediately following this p;:���lic hearin� the Orono Planning <br /> Commission recommended approval of tl�e vacation by a vote of 5-0; and <br /> WHEREAS, in consideration of the following findings the Orono Council finds the <br /> vacation as proposed is in keeping with the public interest: <br /> l. Hanson is the owner of all property abuttina t?�e riaht of�n.�aypr:�posec�t;Le��acate�. <br /> 2. That the portion of the land to be vacated has never provided direct lake access,dead- <br /> ending approximately 40 feet from the lakeshore. This portion of the road was used <br /> to connect with Massasoit Avenue. Massasoit Avenue was vacated in 2002 pursuant <br /> to Resolution No. 4796. This disconnected portion of Meta-Comet Avenue has the <br /> potential to create on-going trespassing on the private land betweeii the lake and the <br /> right-of-way proposed to be vacated. <br /> 3. No direct, public access to any property would be eluninated by the vacation. <br /> Page 1 of 2 <br />
