Oien <br />for his property at 2980 Casco Point Road and the Zoning AdmiJl- <br />istrator t^tesented the Notice of Pii>lic Hearing and Affadavit <br />of M>liCation» Mr* Oien explained that he would like to di­ <br />vide his 51,000 sq. ft. tract into t»lo lots both exceeding 1/2 <br />acre and the 100 ft. lot width requirement. The Zoning Admin­ <br />istrator called attention to a map he had drafted after receiving <br />survey information from the heis^ritig. property owner, Haidltoh <br />Moran. It shiiwed that the present existing Casco Point Road, <br />which did not fbllow the line of the platted road, and right- <br />of-way would nn through the Oien property, thus reducing the <br />available area necessarty to meet the Zoning Code, the Zoning <br />Adninistrator stated that State statutes provide for the righ^ <br />of fliaiicipalities to aquire 33 ft of property on both sides of <br />any road used and maintained for more than six years. Mr. Oien <br />stated that his property was Torrens and felt that it was not <br />likely. Hanilton Moran, idio was in attendance, also expressed <br />interest in the road situation because it would place his ex­ <br />isting house rifi^t in the middle of the road. OIEN <br />2980 CASOO POINT MAD <br />SUBDtVISIGN <br />P.M. <br />The Chairman reopened the regular meeting. Van Nest moved. <br />Hake seconded, that the subdivision aDolication of X^eth <br />W. Oien be tabled until the next meeting in order that a sur­ <br />vey showing the existing roadwi^ and right-of-way in relation <br />to the Oien property be presented and to include an accurate <br />coaputation of tiie dry buildable area excluding the roadway <br />and right-of-way. Motion, Ayes (6) - Nays (0). <br />V ETH W. OIEN <br />2980 CASCO POINT ROAD <br />SUBDIVISION <br />The GoBmission reviewed the application of Ronald Ross to <br />place an accessory building on a thru lot located at 1960 <br />Lakeview Terrace. As the Comwission began to reconmend ap­ <br />proval with a condition requiring Mr. Ross to combine his <br />homestead property with his vacant adjoining lot, Mr. Ross <br /><^jected and requested *diat his adjoining property not be a <br />consideration in the petition. The Commission pointed out <br />that presently his honesite was located in a two acre zone <br />and his existing homesite consisted on one acre. Combina­ <br />tion with the adjoining lot would bring his pr^rty up to <br />present zoning requirements. The Zoning Administrator ad­ <br />vised Mr. Ross that a Building Permit could not be issued <br />for the vacant lot because it consisted of about 751 wet­ <br />lands. He also advised the Planning Commission that a <br />combination now would prevent problems that might result <br />from any new owner purchasing tiie property with intentions <br />to build on a parcel consisting mostly of wetlands. He felt <br />that as long as the two parcels are not conbined, the City <br />would have no control over the sale of each individual <br />parcel. Althou^ Mr. Ross persisted in objecting to this <br />condition. Van Nest pointed out that it was well within <br />the Commission jurisdiction to make recommendation having <br />stipulated conditions. Van Nest moved. Hake seconded, that <br />the Planning Comnission reconmend to the Council approval <br />of the Conditional Use Permit application of Ronald Ross <br />subject to the combination of ^ots 1 and 2, Block 1, long <br />Lake Gomtry Club Addition.
