Hoyt for Property Located <br />at 2523 Kelly Avenue, City of Orono <br />Dear Mr. Gaffron; <br />On behalf of Bradley A. Ho>l, enclosed and hereby submitted is a <br />General Land Use Application for an After-the Fact Conditional Use <br />Permit for landscaping work performed at 2523 Kelly Avenue. I <br />understand that Mr. Hoyt's application will be submitted to the planning <br />commission at its review meeting at the ne.xt available opportunity. <br />When Mr. Hoyt obtained this application from the City, Mr. Paul <br />Weinberger of your office placed an ne.xt to “S250.00 Land <br />Alteration" and an “.x" next to “Grading and filling designated wetland or <br />Hoodplain". Since Mr. Hoyt performed no land alteration within the <br />wetland or floodplain, we do not believe that Mr. Weinberger’s <br />designation is appropriate. The only appropriate designation, if applicable, <br />would be “Grading, seawall, retaining walls withis 75' of lakeshore", as <br />alleged in the City’s counterclaim against Mr. Hoyl in his lawsuit pending <br />in United States District Court. Case No. 99-CD-1034 (JRT/FLN). Since <br />the only portion of that designation that may be applicable is “retaining <br />wall within 75' of lakeshore" we have appropriately checked and <br />modified this box. V\’e have also checked and hereby submit an “After- <br />the-Fact Fee” in the amount of S500.00 for processing this application. <br />Please be advised that Bradley Hoyt makes this request for an <br />After-the-Fact Conditional Use Permit based upon the request of the City <br />of Orono and its attorney s. Greene &.
