Hoyt <br />for an after-the-fact conditional use permit and variances for his property <br />located at 2523 Kelly Avenue. <br />As you are aware, the Planning Commission voted to recommend <br />denial of Mr. Hoyt ’s application for an after-the-tact conditional use <br />permit. Tne Planning Commission, on the recommendation of statf and <br />despite the request of Mr. Ho>'t’s representatives, refused to consider Mr. <br />Hoyt ’s application for cenain variances. <br />At the Planning Commission, the record will reflect the following: <br />1. It was the Cit>’ that identified tlie necessary' after-the-fact <br />permits required upon inquiry from Mr. Ho>1. <br />2 An application was given to Mr. Ho>l by yourself and <br />marked as to the type of permit required by tlie application. A variance <br />was not indicated as required. <br />■ 3. A letter dated October 8. 1999. from yourself in response <br />to Mr. Hoyt ’s application identified certain items necessar>' for <br />consideration of the CUP and the variances. This intoimation was either <br />provided in a timely manner or not available. <br />4.
