1999 Marina Licenses <br />December 9,1999 <br />Page 4 <br />D. North Shore Marina <br />The North Shore Marina operation includes 93 slips in the water (historically the City only <br />allowed 86 slips, but LMCD allows 93) plus a dry stack storage unit with 72 slots (all of <br />which LMCD licenses but only 20 of which Orono has historically allowed for lake use). <br />The property also contains a service building, an office, a "club house" for slip users, and two <br />dwellings, one of which is vacant and the other which is used as a caretaker unit. <br />The site provides ample parking for customers in the summer and a large capacity for storage <br />in the winter. The last two winters this site has been fully utilized for boat storage, and this <br />winter it appears full again. <br />Two activities on the site require a conditional use permit. These include the caretaker <br />dwelling unit and on-demand public boat launching (dry stack operation). Staff has met with <br />Mr. Anderson a number of times regarding the required CUP application. He has <br />acknowledged that these two activities are ongoing absent the required conditional use <br />permit, and has indicated his attorney has advised him to not apply. Both activities requiring <br />a CUP have been ongoing for many years prior to the CUP requirement. Staff/City Attorney <br />review of this issue has not made progress in 1999. <br />E. <br />Activities occurring on the site which require the property owner's ongoing attention in order <br />to remain in compliance with the seven operation standards include limiting storage of boat <br />trailers and other equipment to those areas noted on the approved site plan (specifically <br />keeping the area between the road and the dr\- stack units free of storage). The applicant has <br />been issued permits for some minor landscaping work in this area, and his intent is to <br />continue to beef-up the vegetative screening between the dry-stacks and the road. <br />Staff recommends approval of a 1999 license for North Shore Marina. <br />Lakeside Marina <br />Lakeside Marina did not submit a 1999 license application. Lakeside Marina has 77 rental <br />slips on Maxwell Bay. This is a full-service operation that includes a boat club, repair shop, <br />ship's store, boat brokerage, charter boats berthed at the site and sometimes using it as a port- <br />of-call, and to a limited extent on-demand launching of customer boats stored on site, as well <br />as transient launching when space is available. <br />Lakeside's 1 995,1 996,1 997 and 1998 license applications each indicated that all of the five <br />activities requiring a CUP under the 1995 B-2 Code revisions, were or would be occurring <br />on the site. An incomplete CUP application with S300 fee was submitted by Mr. Duim on <br />May 31,1996. Staff has had numerous contacts with the marina operator since then detailing
