The late fee has been paid. The information in the December 9 staff <br />memo regarding Lakeside Marina is still accurate. <br />It should also be noted that Lakeside removed its old nonconforming underground gasoline tanks and <br />had intended to replace them with an aboveground system during 1999. Specifically pursuant to <br />Lakeside's intent, and in a spirit of cooperation with the Marinas as well as an acknowledgment that <br />State and Federal regulations now strictly govern the design and use of aboveground storage so that <br />the risks of fire and/or spills are minimized; the Council in April 1999 amended the fuel storage <br />ordinances to allow abovegrotind tanks in the B-2 Zoning District. Lakeside has not, however, <br />applied for a new tank permit, and locating an aboveground tank on the site may result in the need <br />for setback or hardcover variance.^. <br />Staff Recommendation <br />Staff recommends approval of a 1999 Marina License for Lakeside Marina along with the other four <br />Orono marinas as noted in the December 9 memo. <br />COUNCIL ACTION REQUESTED <br />Motion to approve the issuance of 1999 Commercial Marina Licenses to Windward Marina, King's <br />Cove Marina, Sailor's World Marina, North Shore Marina, and Lakeside Marina.
