WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.28, Subdivision 5 (B) to permit a side yard setback variance to allow <br />a 612 s.f. two stall attached garage to be located 13.9' where 30' is required from the side lot <br />line. <br />Minnesota: <br />1. <br />5. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />t'his application was reviewed as Zoning File #2525. <br />The property is located in the RR-IB Zoning District, where 2 acres or 87,120 <br />s.f. is the minimum lot area. The property consists of 2.01 acres or 87,410 <br />s.f. <br />The Planning Commission reviewed this application on November 15, 1999 and <br />recommended approval on a vote of 6 to 0. <br />4. The Planning Commission made the following findings of fact: <br />A.The construction of the garage will not exceed the allowable hardcover <br />for the 75-250’ zone, the total hardcover for this zone after the garage <br />addition will be 7,694 s.f. (13.4%). <br />The City Council finds that the conditions existing on this propert)' are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preseive a substantial <br />property right of the applicants; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 6 <br />i«BAk I I U.'ltCll .
