1. <br />3. <br />4. <br />FUNDINGS <br />This application was reviewed as Zoning File #2546. <br />The property is located in the LR-IB, Lakeshore Residential Zoning District <br />requiring 1 acre in area. The property consists of 17,244 s.f. or .39 acres. <br />Hardcover within the 0-75' setback area = 576 s.f. or 6.49%. Existing hardcover <br />within the 75-250' setback area = 4,165.7 s.f. or 49.7%. <br />The Planning Commission reviewed this application on November 15,1999 and <br />recommended approval on a vote of 6 to 0. <br />The Planning Commission recommended approval of the proposed variance based <br />on the following items: <br />A. The triangular shape of the property. <br />B. The unique location of property on a severe āSā* curve. <br />The property does not have a functional garage that can house cars <br />during the extreme cold winter months nor the summer months. <br />Over 50% of the area of this property is located in the 0-75' setback <br />area. <br />The property was developed before the current lakeshore development <br />standards established in 1975. <br />C. <br />D. <br />E. <br />5.The City Council finds that the conditions existing on this property aic peculiar <br />to it and do not apply generally to other property in this zoning district: that <br />granting the variance would iiot adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />Page 2 of 7
