Orono Mayor and City Council <br />November 4,1999 <br />page 2 <br />my understanding that these improvements will commence no later than the spring of 2003. It is <br />my fiL-ther understanding that, in order for Mn/Dot to make its contribution to the construction of <br />the access road, the road bed would have to be dedicated to the public, in the form of an easement <br />in favor of the respective Cities and/or in the form of a platted road. It is also my understanding <br />that Mn/Dot may be able to fund this work at an earlier time. However, Mn/Dot's offer does not <br />extend past the Hwy 12/County Rd. 29 project. <br />The construction of the access road benefits not only the affected property owners but also the <br />City itself As you probably know, another possible access route via Orono property owned 1^ <br />Mr. and Mrs. 'fheis is it issue in a pending court case. Evidence has been found that the City of <br />Orono created a public cartway in 1912 over this other access route. The City may have to <br />become involved in this Utigation in order to determine whether there really is a pubUc cartway <br />over Orono property. This issue will become moot if access over the proposed new service road <br />is established. <br />In summary, my clients support the proposal under which a fi'ontage road would be built <br />connecting Town Line Road to the Rudd Property and they urge the City to do whatever it can to <br />advance the plans for that road including but not limited to: communicating and cooperating with <br />the City of Medina; encouraging Medina to establish the new right-of-way; determining if any part <br />of the new frontage road needs to extend into Orono and working with the City of Me^ the <br />BNSF Railroad and Mn/DOT to confirm the existing crossing is and vrill remain a public right-of- <br />way until the new frontage rc ad is completed. <br />Thank you very much for yoir time and consideration. <br />Very Truly Yours, <br />&H11SEL, LLP <br />BNB/cm <br />encl. <br />cc:Ericka Hawkins (claim # 98-03950) <br />Richard Rudd <br />Jane Slaughter <br />Medina Mayor and City Counsel John B.
