WHEREAS, the control and regulation of adult businesses require intensive police and public <br />health efforts by the City and its contractors and consultants, and that the concentrated use of such <br />services detracts from and reduces the level of services available to the rest of the community and <br />thereby diminishes the ability of the City to promote the general health, safety, and welfare of the <br />community; and <br />WHEREAS, adult businesses are not appropriate in or near locations or areas designed to attract <br />children, such as day care centers, parks, schools, recreation areas, libraries, and churches; and <br />WHEREAS, studies of other cities have shown that the values of both commercial and residential <br />properties either are diminished or fail to appreciate at the rate of other comparable properties when <br />located in proximity to adult businesses; and <br />WHEREAS, the adverse impacts of adult uses are exacerbated when the uses are located near each <br />other; and <br />WHEREAS, the presence of liquor establishments in the immediate vicinity of adult uses also <br />compounds the adverse impacts on the neighborhood; and <br />WHEREAS, adult businesses can increase the risk of exposure to communicable diseases, <br />including but not limited to Acquired Immune Deficiency Syndrome (AIDS), for which there is currently <br />no cure; and <br />WHEREAS, the risk of public health and safety problems can be significantly reduced by careful <br />regulation of adult businesses. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORONO, MINNESOTA HEREB <br />Section 1 - That City Code Chapter Jj), is hereby amended by adding a new Section 62, which shall <br />read as follows: <br />SEC. 10.62. SEXUALLY ORIENTED BUSINESSES. <br />Subd. 1:Purpose. <br />In order to protect the City’s community image, property values, public health, safety, welfare, and <br />business environment, the City has found it necessary, in light of the harmful and unwanted secondaiy' <br />effects that certain businesses generate, to restrict where such businesses may locate within the City <br />and to regulate those businesses. Only those businesses with secondary effects on neighboring <br />properties and the City are intended to be regulated. This Section is not intended to restrict or <br />regulate art. <br />Page 2 of 10
