The ordinance before you was <br />recommended for approval on October 27, 1999 at a pubic meeting. The Planning Commission <br />voted to continue the meeting to November 1, 1999. The second meeting was not scheduled in <br />advance and could not be noticed prior to the meeting. Based on the recommendation of the City <br />Attorney the drafted ordinance before you does not include recommendations from the Planning <br />Commission's second work session. <br />I have summarized the recommendations from the Planning Commission to be added to the proposed <br />ordinance. Added language to the ordinance has been underlined any parts of the ordinance to be <br />omitted has been crossed out. <br />Subdivision 2 (A) 141 <br />4.For purposes of this Section, the term "dominant activity" shall mean any activity or <br />activities that, individually or in combination, provide at least twenty percent (20%) <br />of the gross receipts of the Adult Use's entire business operation at that site, or and <br />occupy or comprise either up to ten percent (10%) or more of the total floor, wall, <br />and shelf area within the site or 150 square feet or more of floor, wall, and shelf area <br />within the site. <br />Subdivision 2 (D) (1) <br />1.Actual or simulated sexual intercourse, oral copulation, anal intercourse, oral-anal <br />copulation, bestiality, direct physical stimulation of unclothed genitals, flagellation <br />or torture in the conte.xt of a sexual relationship, or the use of excretory functions in <br />the context of a sexual relationship, and any of the following sexually-oriented acts <br />or conduct: anilingus, buggery-, coprophagy, coprophilia, cunnilingus. fellatio, <br />necrophilia, pederasty, pedophilia, piquerism. sapphism, zooerasty; or <br />Subdivision 2 (E) (7) <br />7.Adult Motion Picture Arcade. Any place to which the public is permitted or invited <br />wherein coin-, slug-, electronically-, or mechanically-controlled or operated still or <br />motion picture machines, projectors, or other image-producing devices are provided <br />or maintained to show images to five or fewer no more than one persons per machine <br />at any one time, and where the images so displayed are distinguished or characterized <br />by an emphasis on Specified Anatomical Areas or Specified Sexual Activities, and <br />the individual viewing areas are not screened, including but not limited to doors and <br />curtains, in anv wav to obstruct the viewing areas from monitoring. <br />Subdivision 2 (E) H 5) <br />15. Adult Use Other.Anv place to which the public is permitted, a business or commercial <br />enterprise that is distinguished or characterized by an emphasis on <br />Specified Anatomical Areas or Specified Sexual Activities.
