Adult businesses are protected by the First Amendment as a <br />freedom of expression. An ordinance will ensure the City that any requests for adult oriented <br />businesses can be regulated. <br />Summar>' of Draft Ordinance <br />Other communities have recently adopted ordinances relating to adult uses. The proposed ordinance <br />for your consideration incorporates similar components typically addressed and interpreted in other <br />adult use ordinances with our ordinance. Most adult use ordinances separate adult uses into two <br />categories. Principal uses and Accessory uses. Principal adult uses relate to on-site consumption <br />where the sole or a dominant activity is located on the premises of the adult business. Accessory <br />adult uses would include primarily off-site consumption with total retail space dedicated for adult <br />uses being 10% or less of the retail space, and not to exceed 150 square feet. <br />Principal uses would be allowed in the I, Industrial District, and accessory uses would be allowed <br />in the 1 and B-1, B-3, B-4, B-5, B-6, Business Districts w here the primary use of the business is a <br />permitted or conditional use. The B-2 district is for marina use. All our marinas are immediately <br />adjacent to residential properties. The intent is to permit adult uses in concentrated commercial and <br />industrial areas not to negatively impact residential properties and neighborhoods.
