Instruct people to stay clear of the area. <br />· Immediately contact 911 to report a major spill, active illegal <br />dumping, or a potential fire threat. <br />· If the source of the illegal discharge is a spill or leak as defined in <br />Minnesota Statute 115.061, the following offices shall be notified <br />immediately: <br />MN Dept. of Public Safety Duty Officer: 651-649-5451 or 1-800- <br />422-0798 <br />Non-Emergency Police Dispatch: 952-249-4700 <br />Minnehaha Creek Watershed District: 952-471-0590 <br />· Take detailed notes and photos/video for subsequent investigation <br />by City or other agencies. At a minimum, the following shall be <br />recorded: <br />Location <br />Spill material <br />Spill volume <br />Party responsible for spill <br />Impact to resources (infrastructure, surface waters) <br />· If possible, isolate or contain visible chemical pollution in the effected <br />waterbody with any materials that are accessible. For small <br />discharges earth dams, absorbent pads, and containers may be useful <br />to contain part of the illicit discharge (see Appendix H for Spill <br />Response Plan). <br />2. Corrective Actions / Enforcement <br />a) The City will respond to identified illicit discharges, illicit connections, or illegal <br />dumping activities using progressive enforcement actions. Corrective actions will <br />focus first on education to promote voluntary compliance and escalate to <br />increasingly severe enforcement actions if voluntary compliance is not obtained. <br />b) Voluntary Compliance – for first time offenders, the City shall immediately notify <br />the party responsible of the illegal connection or operation and may provide the <br />responsible party with educational information about the illegal connection or <br />operation, environmental consequences, and/or suggestions on remedial actions. <br />After initial notification, the responsible party will be directed to initiate necessary <br />remedial actions in a timely manner to be determined by the Investigator (time <br />will vary based on nature of illegal connection or operations). Based on the time <br />allotted by the Investigator, a follow-up inspection shall be performed to verify <br />compliance. <br />c) Notice of Violation - Whenever the City finds that a person has violated a <br />prohibition or failed to meet a requirement of Ordinance subchapters 14.301-310, <br />the City may order compliance by a written Notice of Violation to the responsible <br />person. The notice may require without limitation: <br />· The performance of monitoring, analysis, and reporting.
