To grant an extension to the final Master Development Plan approval for the 56-unit <br />apartment building at 2475 Kelley Parkway. <br /> <br />2. Background. In April, 2020, the City Council approved the final Master Development Plan which <br />was the final step in the approval necessary to facilitate construction of the 56 unit 2 ½ story apartment <br />building on a vacant lot at 2475 Kelley Parkway immediately east of the Orono Dentist office. <br /> <br />The Resolution of approval included the statement: The approvals granted by this resolution run with the <br />Property not with the Applicants, but are permissive only and must be exercised by obtaining a building <br />permit for the new construction and commencing construction of said project. A building permit for the <br />principal building shall be obtained within one year of the date of Council approval, if no permit is issued <br />or extension granted by the City Council, the City Council may declare the approvals granted within this <br />resolution as null and void on that date (April 13, 2021). <br /> <br />On February 10, 2021 Staff granted a 1-year administrative extension until April 13, 2022. On January <br />24th, 2023 the City Council granted an extension (Resolution 7248) until April 13, 2023. The applicant <br />has requested an additional 1-year extension. The City Code does not limit the number of extensions <br />allowed. <br /> <br />3. Request. The applicant requests an extension for one year. <br /> <br />4. Staff Recommendation. Staff recommends the Council approve a 12-month extension to April 13, <br />2024. <br /> <br />COUNCIL ACTION REQUESTED <br />City Council should adopt the approval Resolution No. 7354. <br /> <br />Exhibits <br />A.
