(S <br />MEMO <br />TO:Orono City Council <br />FROM:Chief Gary Cheswick <br />DATE:October 21, 1999 <br />SUBJECT: Liquor License Application <br />Upon completion of the background check of Mr. James Duane Anderst, the results show past <br />violations of State law and local ordinances. The investigation reported violations of Minnesota <br />Criminal Law resulting in a conviction of criminal sey^ial conduct. Mr. Anderst additionally has <br />several complaints for violation of the Minnetonka Beach noise/construction ordinance. These <br />complaints are currently being reviewed by the city attorney. However, based on the review of <br />Minnesota liquor law, these previous and existing violations lack sufficient foundation for denial <br />by the state. <br />Based on this investigation, it would be difficult to make a positive recommendation for approval <br />of the liquor license for by James Anderst. Final determination whether these violations are <br />sufficient cause to deny the Orono liquor license application is for Council determination.
