A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE #2538 <br />WHEREAS, Robert T. Jaffray and Victoria H. Jaffray (hereinafter "the <br />applicants") are owners of the property located at 540 Barrett Avenue within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />Lots 16, 17, 18, 19, 20 and 21, Block 14, Minnetonka Bluffs, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Plaiming <br />Commission held a public hearing on October 18, 1999, at which times all persons desiring <br />to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.28, Subdivision 5 (B) to permit construction of dormers on the second <br />story of an existing residence, changing the roof line, located 25' from the front/street lot line <br />instead of meeting the required 50' setback. <br />Minnesota; <br />1. <br />2. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #2538. <br />The property is located in the RR-IB, Lakeshore Residential Zoning District <br />requiring 2 acres in area. The property with combined Lots 19, 20. and 21 and <br />separately owned Lots 15, 16, 17 and 18 consists of .88 acres or 38.700 s.f. <br />Page 1 of6
