Duncan MacMillan has applied for a conditional use permit to allow land alteration of greater <br />than 500 cubic yards and to permit grading within 5' of the property lines for redirecting a driveway <br />access further to the east across a commonly owned property line. A 30 foot wide access easement <br />would be granted by the 1700 Fox Street lot to the 1820 Fox Street lot. <br />The existing driveway is quite steep. The proposed driveway would be at an 8% slope and the <br />landing to Fox Street would be only 2%. The proposed drive would greatly reduce the overall slope <br />for a driveway. <br />STAFF RECOMMENDATION <br />Staff recommends approval of the application for Conditional Use Permit for fill of greater than 500 <br />cubic yards and to allow grading to occur within 5 feet of a property line to permit an existing <br />driveway to be relocated across a commonly owned property line subject to the conditions noted in <br />the attached resolution.
