WHEREAS, At their regular meeting held on September 27,1999, the Orono City <br />Council considered the subdivision application of Douglas and Claudia Whiteley; and David and <br />Heidi Hust, noting the following fmdings of fact: <br />1.The property is located within the RR>1B, Single Family Rural Residential District <br />requiring a minimum of 2 acres lot area. The existing lots are as follows: <br />60 Orono Orchard Road 55,862.6 s.f. <br />45 Smith Avenue 52,350.2 s.f. <br />2.Both lots are scheduled for sanitary sewer installation. The rearrangement will not <br />require drainfield sites on each lot. <br />3. <br />4. <br />Drainage and utility easements have been dedicated along interior property lines. <br />Lots in the RR-IB district are required to be 200 ’ wide at the front yard setback. <br />Each lot increases 17' in width. The impact on the rear property width would be <br />minimal with each lot only losing 17' in width at the rear. <br />5. The code defmes subject lots as through lots. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of Orono <br />hereby approves the lot line rearrangement of the above referenced property by the subdividers <br />as shown on the certificate of survey by David E. Crook, a licensed surveyor, dated July 21, 1999 <br />and revised September 20,1999, attached Exhibit "B". The approval is subject to the following <br />conditions: <br />1.TTie new legal description for Parcels A and B, as shown on the survey sited above, <br />shall read as follows: <br />Exhibit "A <br />2.
